NOTICE OF POSTING OF ADOPTED ORDINANCE

PLEASE TAKE NOTICE that at a meeting of the Fruitport Charter Township Board held on September 27, 2021 the Board had a second reading of and adopted the Floodplain Management Provisions of the State Construction Code Amendment Ordinance.

The Ordinance (No. 825) will revise the designation of regulated flood prone hazard areas within Fruitport Township. This Ordinance shall be effective September 30, 2021.

FLOODPLAIN MANAGEMENT PROVISIONS OF THE STATE

CONSTRUCTION CODE AMENDMENT ORDINANCE

AN ORDINANCE TO AMEND THE CODE OF ORDINANCES OF THE CHARTER TOWNSHIP OF FRUITPORT, MUSKEGON COUNTY, SPECIFICALLY ARTICLE IV, ENTITLED FLOODPLAIN MANAGEMENT PROVISIONS, OF CHAPTER 6, BY REVISING THE DESIGNATION OF REGULATED FLOOD PRONE HAZARD AREAS.

THE CHARTER TOWNSHIP OF FRUITPORT, COUNTY OF MUSKEGON, AND STATE OF MICHIGAN, ORDAINS:

Section 1.        Amendment of Section 6-72.  Section 6-72, designating the flood prone hazard areas, of Article IV, Chapter 6, known and cited as “Floodplain Management Provisions,” is amended to read in its entirety as follows.

Sec. 6-72.        Designation of regulated flood prone hazard areas. 

The Federal Emergency Management Agency (“FEMA”) Flood Insurance Study (“FIS”) Entitled “Muskegon County, Michigan (All Jurisdictions),” effective October 7, 2021, and the relevant Flood Insurance Rate Map (“FIRM”) panels (26121CIND0B, 26121C0279E, 26121C0287E, 26121C0289E, 26121C0293E, 26121C0294E, 26121C0406E, 26121C0407E, effective October 7, 2021 and 26121C0285D,  effective July 6, 2015) are adopted by reference for the purposes of administration of the Michigan Construction Code, and declared to be a part of the Michigan Building Code, and to provide the content of the “Flood Hazards” section of the Michigan Residential Code.

Section 2.        Effective Date.  This Ordinance was approved and adopted by the Township Board of Fruitport Charter Township, Muskegon County, Michigan, on September 27, 2021, after introduction and a first reading on September 13, 2021, and publication after such first reading as required by Michigan Act 359 of 1947, as amended.  This Ordinance shall be effective immediately upon its publication.
